  • NGOs, Societies, and Trusts: Non-profit organizations, societies, and trusts can also apply for trademarks to protect any distinctive marks associated with their operations.
  • Foreign Nationals and Entities: Foreign individuals or companies can apply for trademark registration in India to secure their brand if they plan to operate or offer services/products within the country.

Criteria for Eligible Trademarks

  • Distinctiveness: The mark must be unique or distinctive, allowing customers to differentiate it from other brands. Common names, terms, or marks similar to existing registered trademarks are usually not eligible.

Comparison between Trademark, Copyright and Patent

™ (Trademark)
The symbol ™ shows the word, phrase, and logo is claimed as a trademark. With the trademark you protect, you protect your brand from others using it.  The symbol (TM) you should use until your application is reviewed by USPTO to get registered as a trademark.

® (Registered Trademark)
The symbol ® is used only when the trademark is registered.
The use of the circled R symbol ® is not allowed until you receive the registration. If a company started using the circle R symbol ® just after applying for a trademark, then it will be considered as breaking the rules, and the government can be denied the trademark

℠ (Service Mark)
The service mark is only used when a business takes rights against any service. The use of SM is similar  to ™ 
is used while waiting for 

The SM mark ℠ is similar to the process of trademark registration. In general terms, we use the word trademark for service mark as well, but while representing, offering, and claiming the rights on the trademark, the SM mark is technically the correct symbol.

Procedure of Trademark Registration

Trademark Search
You should have detailed information on your desired trademark and the industries. You need to search first in which thing you want your mark Once you are done with the trademark search, then you are good to go for further steps.

Filling trademark application
In the next step of trademark registration, you have to fill out the trademark application. There are two ways of filling a trademark.

You can e-file your trademark application by (form TM-A), and you will get an acknowledgement receipt immediately. There is another way of manually filling in you have to personally visit the registrar’s office of Trademark and hand over the application in major cities in India like Delhi, Mumbai, Ahmadabad, and Chennai, and it takes 15-20 days to receive the acknowledgement.

Examine and Publication of the trademark
When the file is submitted, the registrar will review the filling, and there should not be any similarity with any other existing brand that is pending registration. Just after the examination, the registry of Indian trademarks will publish your trademark in their journal.
